IRS Federal Tax Lien: Notice and Release

What is an IRS Federal Tax Lien?  The IRS federal tax lien is a legal instrument that secures the claim of the Internal Revenue Service in the right, title, and interest of a debtor taxpayer's assets. It is a public document and is recorded at the County Clerk's office or the Secretary of State, depending on local law. This is done to serve notice on all creditors or other interested parties of the government's claim. The IRS tax lien attaches to all your property (such as your house or car) and will also include property you acquire after the IRS lien is filed. The IRS federal tax lien is a negative item on the taxpayer’s credit report and will make it difficult to secure future loans or other types of credit.

What is a Notice of Federal Tax Lien?  The Notice of Federal Tax Lien is the filing done after the IRS has assessed the delinquent tax liability and sent a Notice and Demand for Payment.  This IRS Notice and Demand for Payment provides the taxpayer with the amount of taxes owed and a 10 day time limit to respond.  Once the Notice of Federal Tax Lien is filed, and has attached to all your property, it is prudent to seek professional IRS tax lien help.  A qualified IRS advisor or tax attorney can provide what your tax lien relief options are to remove or release this IRS tax lien as quickly as possible. Keep in mind that once this Notice of Federal Tax Lien has been filed, your credit report will be negatively affected.

How to Secure an IRS Lien Release?  The IRS federal tax lien essentially remains in place until the past tax liability has been resolved in the eyes of the IRS.  When the IRS tax amount is paid in full, the tax lien release can occur.  The IRS also accepts monthly payment plans, called installment agreements, where the entire tax debt is paid back “over time.”  An IRS lien removal will occur when the installment agreement is completed.  IRS lien specialists can provide invaluable help with the filing of an Offer in Compromise.   A release of the federal tax lien will be granted when your offer is accepted. This tax relief solution is considered the most beneficial as it reduces the IRS tax debt owed to a fraction of the total.  The posting of a bond that guarantees payment is another tax lien release solution but is unlikely for most taxpayers who are in severe financial hardship. Regardless of the reason for the federal tax lien release, the IRS will confirm it by issuing a Certificate of Release of Federal Tax Lien within 30 days.

What is the Certificate of Release?  It is important that the Certificate of Release of Federal Tax Lien (Form 668Z) be sent to the credit bureaus so it is recorded in your credit report history.  This will not remove the federal tax lien from your credit report.  Your credit report will reflect the reporting of the original IRS tax lien, but once the Certificate of Release is received, it will also show the release of the federal tax lien. This will stay on your credit report for up to 10 years after the lien release is issued.
